1. Basic Information

2. Scope of Business
Kallure Creative Studio provides services in web design, programming, graphic design, creation of visual prototypes, media content production, and handmade souvenirs.
3. Ordering Process
The order can be placed via email, social media (Instagram) or through the contact form on the website.
4. Prices and Payment Methods
All prices are expressed in euros (EUR). The company is not subject to value-added tax (VAT) according to Article 90, paragraph 1 of the Value-Added Tax Act.
Payment is possible exclusively via bank transfer to the company's business account.
Cash payment is not available.
5. Advance Payment
For certain services (e.g., web pages, design), advance payment may be required as specified in the offer.
The advance payment confirms the order and is considered acceptance of the offer terms.
In the event of contract termination, a part of the advance payment proportionate to the work performed and costs incurred up to that point is retained. If the service is not performed due to the company's fault, the advance payment is refunded in full.
6. Delivery of Products/Services
Digital products and services (web pages, design) are delivered electronically upon completion of the work and payment.
Physical products (handmade items) are delivered personally or by a delivery service, as agreed with the customer.
The cost of delivery is borne by the customer, unless otherwise agreed.
7. Right of Withdrawal (Consumers)
In accordance with the Croatian Consumer Protection Act, a consumer who concludes a distance contract (via email, social media or the website contact form) has the right to withdraw from the contract within 14 days without stating a reason — for services, from the day the contract is concluded; for products, from the day of receipt. Withdrawal is exercised by an unambiguous written statement sent to kallure.creative.studio@gmail.com. This right applies exclusively to consumers (natural persons) and does not apply to business customers.
The right of withdrawal does not apply to: products made to the consumer's specifications or clearly personalized (custom-made and personalized handmade products), or to services that have been fully performed, if performance began with the consumer's express prior consent and their confirmation that they are aware of losing the right of withdrawal once the service is fully performed.
If the consumer requests that the performance of a service begin before the expiry of the withdrawal period and then withdraws from the contract before the service is fully performed, they are obliged to pay a part of the price proportionate to what was performed up to the moment of withdrawal.
8. Complaints
The customer has the right to file a complaint about a material defect of a product or service in accordance with the provisions of the Croatian Civil Obligations Act.
Visible damage caused during delivery should be reported within 48 hours of receiving the product, so that a claim can also be made with the delivery service.
In the event of withdrawal from the contract, the consumer bears the direct cost of returning the product and is liable for any diminished value of the product resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the product.
In accordance with the Consumer Protection Act, you can submit a written complaint via https://forms.gle/7uSRjwosdPpbENaT8, by email to kallure.creative.studio@gmail.com or by post to Kallure Creative Studio, Medulinska cesta 39P, 52100 Pula. We will respond to your complaint in writing within 15 days of receipt.
If you are not satisfied with our response to your complaint, you have the right to free out-of-court consumer dispute resolution (ADR) through the Croatian Chamber of Trades and Crafts: https://www.hok.hr/adr
9. Data Protection
All personal data collected during business operations are used exclusively for the purpose of fulfilling orders and are not shared with third parties, except where required by law or necessary for the performance of the service. More information is available in the Privacy Policy.
10. Intellectual Property and Copyright
All materials, designs, web pages, digital prototypes, photographs and other products produced by Kallure Creative Studio are protected by copyright.
Transfer of intellectual property rights to the customer is possible only if explicitly stated in the offer or contract.
The customer does not have the right to sell, distribute, modify, or copy materials without written permission from the company, unless otherwise agreed.
11. Other
For all matters not covered by these Terms of Service, the provisions of the Act on Obligatory Relations and the Act on Consumer Protection of the Republic of Croatia shall apply.
